In July 0f 2020, the U.S. Department of Justice (DOJ) and the U.S. Securities and Exchange Commission (SEC), released the second edition of its resource guide on the U.S. Foreign Corrupt Practices Act (FCPA). This is only the second resource guide issued by the DOJ and the SEC on the FCPA and updates the first resource guide issued eight years ago, in 2012.
Understanding the FCPA and Thai anti-corruption laws is critical to everyone doing business in Thailand. Financial penalties for FCPA violations have increased substantially, with an estimated 2.9 billion in fines imposed for violations that involved Asia Pacific, including Thailand. And a DOJ official announced in 2019 that the DOJ will focus on individuals responsible for FCPA violations, stating "the most effective deterrent to corporate criminal conduct is identifying people who commit crimes and sending them to prison"
Stay current on this challenging subject with our panel of experts on the FCPA and Thai anti-corruption laws. The panel will include a senior compliance officer from Chevron, Sangita Patel, who will join from the U.S. and provide an in-house perspective on the compliance challenges presented by the FCPA; Douglas Mancill, who has worked with U.S., European and Japanese multinationals on the FCPA and other anti-corruption laws for over thirty years; Shin Honma, who leads the Risk Consulting and Forensic Services practice for PcW Thailand; and John Frangos, a partner at Tilleke who co-leads the firm's compliance and investigations practice.
About the Speakers:
- Sangita Patel, Deputy Chief Compliance Officer, Chevron. Ms. Patel has been with Chevron since 2005 and has helped develop and enhance the compliance program at Chevron. She is the subject matter expert for Chevron on global anti-corruption, conflict of interest, trade sanctions/money laundering, import/export and antiboycott laws and regulations.
- Douglas Mancill, Partner, Mulvana de Angeli & Associates. He is a dual national (Thai and the U.S.) California qualified lawyer who handled his first FCPA matter before he was seconded to Thailand in 1998. He has decades of on the ground experience in Thailand conducting compliance reviews and providing advice to U.S., European and Japanese multinationals companies on the FCPA and other anti-corruption laws. Douglas has over 30 years' experience at large and medium size firms in the U.S. and Thailand. His practice focuses on contentious matters (including a seven-week jury trial in the U.S. and international arbitrations), corporate and commercial matters and compliance work.
- Shin Honma, Forensic Services Partner, PricewaterhouseCoopers Thailand. Shin possesses over 20 years of experience assisting global companies with issues related to fraud, bribery and corruption, employee misconduct, crisis management, and risk management. Shin spent the first 14 years of his career working in the United States, and over the last 7 years, he has been based in Asia. Shin has been based in Bangkok since January 2020.
- John Frangos, Partner, Tilleke & Gibbins. John is a New York qualified lawyer and partner and deputy director of Tilleke & Gibbins' dispute resolution group. From the firm's head office in Bangkok, he assists clients on complex disputes in Southeast Asia, including cross-border commercial litigation, regulatory and corporate investigations, white-collar crime and anti-corruption, aviation disputes, bankruptcy and restructuring litigation, and arbitration. He co-leads the firm's compliance and investigations practice and leads the firm's aviation practice.
